These Terms of Service ("Terms") govern your use of this website (the "Site"), operated by Custom Academic Coaching ("we," "us" or "our"). By using the Site you agree to these Terms. If you do not agree, please do not use the Site.
The Site and our services
The Site describes our educational coaching and consulting services and provides general information. It does not create a client relationship. Services are provided only under a separate written agreement signed with each client, which sets out the scope of work, fees, payment, scheduling, cancellation and refunds. If that agreement and these Terms conflict, the agreement controls for the services it covers.
Prices are estimates, not offers
Prices, package descriptions and session counts on the Site are estimates for general information. They are not offers and may change without notice. The price and terms of any engagement are those in the written agreement for it. The Site does not take orders or payments.
No guarantee of outcomes
Our coaching and guidance are advisory and educational. Admission, scholarship and financial aid decisions are made solely by the schools, programs and organizations involved. We do not and cannot guarantee admission to any school or program, any scholarship or financial aid award, or any particular test score or result. See our Professional Disclaimer for more.
Testimonials and results
Testimonials and examples of past students' results reflect individual experiences. Every student is different, and past results do not predict or guarantee future outcomes.
Our content
The text, design, logos, graphics and other content on the Site belong to Custom Academic Coaching or are used under license, and are protected by copyright and trademark law. Images on the Site are owned by us or licensed for our use; they may not be copied or reused. You may view and print pages for your personal, non-commercial use. Any other copying, distribution or adaptation needs our written permission.
Using the Site
Please do not misuse the Site. In particular, do not:
- use it for anything unlawful or to send false or misleading information;
- try to gain unauthorized access to it or to our systems, or interfere with its operation;
- copy its content in bulk, including by scraping or automated collection; or
- impersonate anyone or misrepresent your relationship with anyone.
Third-party services and links
Booking is handled by Acuity Scheduling, under its own terms and privacy policy. Links to other websites, including school and testing-agency sites, are provided for convenience. We do not control those sites and are not responsible for their content or practices.
Privacy
Our Privacy Policy explains how we handle information collected through the Site.
Disclaimer of warranties
The Site and its content are provided "as is" and "as available." Admissions requirements, deadlines, costs and policies change often, and we do not warrant that information on the Site is complete, current or error-free. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
Limitation of liability
To the fullest extent permitted by law, Custom Academic Coaching and its owners, staff and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any lost opportunity (including any admission, scholarship or financial aid decision), arising from your use of, or inability to use, the Site or its content. Our total liability for any claim relating to the Site is limited to one hundred U.S. dollars (US$100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you. Liability for services is governed by the client agreement.
Indemnity
You agree to indemnify and hold harmless Custom Academic Coaching from claims, losses and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or your violation of these Terms.
Governing law
These Terms are governed by the laws of the place where our business is located, without regard to its conflict-of-law rules, and any dispute arising from them or the Site will be resolved in the courts there.
General
If any part of these Terms is found unenforceable, the rest remains in effect. Our not enforcing a provision is not a waiver of it. We may update these Terms; the date at the top shows when they last changed, and continuing to use the Site after a change means you accept the updated Terms.
